123-reg Malware Monitoring Terms and Conditions

These 123-reg Malware Monitoring Terms and Conditions are supplemental to 123-reg's General Terms and Conditions and Acceptable Use Policy and StopTheHacker's Disclaimer. You will be bound to all of these when carrying out business with 123-reg for the purchase of a Malware Monitoring product.

1. Scope of the Agreement

1.1 This Agreement governs the provision of Malware Monitoring products purchased by You through 123-reg, in addition to certain maintenance relating to the same (the "Services").

1.2 Every reasonable effort is made by 123-reg to maintain the uninterrupted operation of Your Services. Despite this, due to a number of circumstances that are beyond 123-reg's control, you acknowledge that given the nature of such services, 123-reg cannot guarantee that the Services, when delivered via the internet, will be uninterrupted or error free.

2. Service Delivery

2.1 Customers may purchase Malware Monitoring products through 123-reg via their Control Panel if they are existing customers and via the 123-reg.co.uk website.

2.2 Customers are responsible for the actual, physical removal of the malicious code from their websites.

2.3 The service includes email notification of detected malware to the email address in the relevant 123-reg account. Customers acknowledge that although this email notification is sent using the email address no-reply@123-reg.co.uk it is not sent by 123-reg directly.

2.4 The information presented here is intended to allow visitors to confirm the efforts taken by this website to protect them from web malware, protect its reputation, and avoid compromise. The presence of the StopTheHacker website protection seal or evidence of service offers or implies no implicit or explicit guarantees. Security is an arms race and websites must remain vigilant and take all measures necessary to protect themselves against malicious attack. The StopTheHacker seal signifies that this website is aware of these threats and has taken steps to improve its security.

3. Fees and Billing

3.1 The Services shall be charged in accordance with the fees set by 123-reg as set out in the Order Confirmation. These may be varied from time to time and published on the 123-reg website.

3.2 When the Services are renewed in accordance with the Agreement, the fees will be charged at the current rate as published on the 123-reg website.

3.3 Customers may change their billing periods from monthly to yearly and vice versa via their Control Panel.

3.4 In the event that Customers change their billing periods from monthly to yearly, Customers will be billed from the start of the next calendar month. At his point the expiry date will be extended by 12months from the end of the original billing period.

3.5 In the event that Customers change their billing periods from yearly to monthly, refunds will not be made to the customer due to annual payments being made in advance. The monthly billing shall commence after the first 12 months have completed.

4. Cancellations, Refunds and Renewals

4.1 Customers who wish to cancel their services with us must contact 123-reg support via telephone before the end of their contract or the next billing date.

4.2 Customer acknowledges and understands that 123-reg is not obliged to provide Customers with pro rata refunds on unused services.

4.3 All services are automatically renewed. Customers must "opt-out" through their Control Panel should they prefer their services to cancel at the end of their contract.

5. Upgrades and Downgrades

5.1 Customers may upgrade their Malware Monitoring products and services via their Control Panel.

5.2 In order to Downgrade services, Customers must contact 123-reg Support via telephone.

5.3 Customers acknowledge and accept that 123-reg are not obliged to issue pro-rata refunds in any event.

6. Appropriate Usage of the Services

6.1 The terms governing the appropriate use of Your Services and the Malware Monitoring products can be found in the Acceptable Use Policy.

6.2 Further to section 6.1 above customers are prohibited from changing the domain name used when first purchasing any Malware Monitoring products. In the event that this occurs customers acknowledge and understand that 123-reg reserve the right to deactivate your Malware Monitoring services.

7. Support

7.1 123-reg will provide "Support" to Customers for Malware Monitoring products purchased, during Support hours as detailed on the 123-reg website.

7.2 "Support" extends to assistance only and will not include the editing of a Customer's site files.

8. Remedies & Limitations

8.1 THE TOTAL SOLE AND EXCLUSIVE REMEDY AVAILABLE TO YOU AS THE RESULT OF ANY BREACH OF THIS AGREEMENT, NEGLIGENCE, OR ANY ACTION OR FAILURE TO ACT WHETHER INTENTIONAL OR OTHERWISE SHALL BE LIMITED TO THE TOTAL AMOUNT OF FEES PAID BY YOU TO 123-REG IN THE TWELVE MONTHS IMMEDIATELY PRECEDING ANY ALLEGATION OF THE AFOREMENTIONED ACTIONS.

8.2 In no event shall 123-reg be liable for any loss of profits, loss of business, or any indirect, special, exemplary, punitive, incidental or consequential damages as the result of any such action or inaction without regard to the likelihood of any such damages.

8.3 123-reg is not responsible for any delay, lack of connection, slow connection, loss of data, loss of usability, or any other similar issues, due, but not limited to, any of the following:

  • 8.3.1 the active or passive negligence of 123-reg, You or any third party;
  • 8.3.2 downtime due to scheduled maintenance;
  • 8.3.3 an upgrade, downgrade or other alteration to Your Services or the Malware Monitoring;
  • 8.3.4 hardware failure, (including issues caused by other users on hardware);
  • 8.3.5 incompatibility; or
  • 8.3.6 Your error.

8.4 123-reg may limit or deny access to Your Services and its systems if, in 123-reg's judgment and sole discretion, such action is required to prevent damage to the network (including, but not limited to, software and stored data) or to ensure the integrity or security of the network.
